The Tramway Company Has dow Taidajskort

length of double track past the Golf Club House at Happy Valley, omitting the concrete surfacing between the two tracks. My letter of the 20th. July last has been disregarded.

I propose to inform Mr. Hackwood, the Company's representative, that I decline to issue any further permits to open any of the roads until he gives an undertaking in writing to comply with the approved section in constructing the Tramway and to bring into compliance with such approved section any portion of the Tramway already constructed in which a devia- tion from it has been made.

The position is that practically the whole

of the work for which permits have already been issued has now been completed and there are only a few short lengths of Tramway in which the concrete surfacing between the tracks has been omit- ted.

I take it that, under sub-section 2 of

Section 11 of the Tramway Ordinance (No. 10 of 1903, the Company cannot proceed with the laying of the Tramway if I withhold the permit to open any road.

I submit my proposal for approval in the

first instance. Possibly some other course may be considered preferable, such as applying for an injunction to restrain the Company from proceeding with the work.
